Background

Mr. Daken earned both his Master of Science in Electrical Engineering and Bachelor of Science in Electrical Engineering at the New Jersey Institute of Technology and a Master of Business Administration at William Paterson University. Mr. Daken's areas of expertise include technical investigations, analysis, reports, testimony towards the resolution of commercial and personal injury litigation and failure analysis involving medical equipment and accompanying procedural issues within a hospital or health care setting. His experience and knowledge covers over 30 years and includes teaching Biomedical Engineering, Clinical Engineering and a variety of Electrical Engineering courses.

Mr. Daken's background also includes testimony on medical device malfunctions, electrical shock and equipment related injuries, damage to equipment due to maintenance issues, damage to equipment due to electromagnetic interference, fire damage, water damage, injuries related to improper procedure and/or non-compliance with appropriate standards, regulations and product manuals. He is also experienced in technical investigations, analysis and reports pertinent to insurance claims resulting from equipment damage due to fire, water intrusion, improper maintenance and improper installation or other defects.

    • Provide (clinical engineers) engineering specialists who can help the client address claims involving healthcare technology in areas such as design of the medical device/technology, manufacturing defects, shipping concerns, installation issues, maintenance issues, education of staff (users and maintainers), patient safety, electrical and equipment safety, environmental concerns, and special issues involved with placing medical technology in the home healthcare arena.
  • Electrical Evaluation
    • Responsible for technical investigations, analysis, reports, and testimony towards the resolution of commercial and personal injury litigation and failure analysis involving medical equipment and accompanying procedural issues within a hospital or health care setting.
    • Provide technical investigations, analysis, reports, and testimony for litigation or insurance claims pertaining to failures or damage to electrical distribution systems and/or electrical/electronic equipment arising from fire, water intrusion, improper installation, improper maintenance, misuse, or defect.
    • Investigating and assisting in resolving incidents where the issues involved electric shock, fires of electrical origin and malfunctions of electrical equipment.
    • Has been the principal investigator in matters involving medical equipment operation and failure, failures or damage to MRIs and patient safety in healthcare environments
    • Responsible for technical investigations, analysis, reports, and testimony towards the resolution of commercial and personal injury litigation and failure analysis involving medical equipment and accompanying procedural issues within a hospital or health care setting.
