Oil Spill Toxic Tort – Medical-Legal Nurse Review

June 22, 2023

Background

A 36-year-old claimant complained of blurred vision, eye burning/irritation, rashes, gastric reflux, and trouble breathing since working for a contractor as part of a massive oil spill clean-up to remove heavy oil from shorelines with shovels and brushes. She filed a claim alleging occupational exposure to oil and dispersants.

Services Provided

The Rimkus Legal Nurse Consultant systematically reviewed the medical records and determined the patient had a long history of gastric reflux and asthma prior to her work cleaning oil on the shoreline. Our comprehensive review determined that there were no provider statements in the medical records that linked the claimant’s occupational exposure to her complaints.
