Construction Law Roundtable: Legislative Developments in Malaysia

The Bar Council Arbitration and Construction Law Committee (ACLC) is hosting a roundtable discussion on the latest and upcoming legislative changes affecting construction law and practice in Malaysia. Key topics include the move toward mandatory mediation and the upcoming Government Procurement Bill 2025.

The session will bring together professionals from both the legal and construction sectors to share perspectives, stay up to date with important developments, and discuss ways to strengthen best practices within the field.

The roundtable will be held in a hybrid format, offering both in-person and online participation. Members are encouraged to attend in person to make the most of the discussions and networking opportunities. Those joining virtually will receive the Zoom link closer to the event date after registration.

Speakers

Dato Mary Lim Thiam Suan

Director, AIAC; Retired Federal Court Judge

Dato Mary Lim Thiam Suan has extensive experience in arbitration and alternative dispute resolution, having sat as the first Judge of the Construction Court in Kuala Lumpur and has written numerous judgments in this area of the law. She currently holds several academic commitments apart from being a member of the special advisory committee of the Permanent Forum of China Construction Law, member of the Judicial Integrity Network ASEAN advisory group, fellow of the International Academy of Construction Lawyers, Chairperson of the Code Administration Committee and Judge of the Bahrain International Commercial Court.

Kamilah Kasim

Partner, Rahmat Lim & Partners

Kamilah Kasim heads the Energy, Infrastructure and Projects practice area at Rahmat Lim & Partners and is a member of the Protem Committee for AIAC Court of Arbitration. Her work focuses on both contentious and non-contentious infrastructure projects across Asia, particularly on complex engineering and energy ventures.

Kamilah advises on the privatisation of public sector businesses and private sector infrastructure development, negotiating critical agreements, including power purchase and construction contracts.

Ranked in The Legal 500 Asia Pacific Hall of Fame, she is acknowledged for her commercial acumen, client-centric approach and arbitration experience. She is also acknowledged as a “Market Leader” and “Women Leader” in the International Financial Law Review 1000 for project development, and “Woman Lawyer of the Year” at the Asian Legal Business Malaysia Law Awards 2023. During her tenure, Rahmat Lim & Partners has been ranked Band 1 under Projects, Infrastructure and Energy in Chambers Asia-Pacific for 11 consecutive years.

Kamilah is concurrently a partner at Allen & Gledhill in Singapore.

Abang Iwawan

Partner, Abang & Co

Abang Iwawan is the Managing Partner of Abang & Co, where his practice focuses on international arbitration and both contentious and non-contentious infrastructure-related matters across Asia. He has acted as counsel or sole arbitrator in complex, high-value matters involving energy (including renewables), water and waste management, utilities, mixed development, transportation, and heavy industry.

He is the Chairperson of the Bar Council Arbitration and Construction Law Committee and regional representative for South Asia (2024 to 2026) at the International Chamber of Commerce Young Arbitration and ADR Forum (“ICC YAAF”). He is also a Fellow of the Chartered Institute of Arbitrators (UK) and is empanelled as an Arbitrator with AIAC and Borneo International Centre for Arbitration and Mediation.

Beyond his commercial practice, Iwawan is active in legal and policy work on sustainable development and climate change. He currently serves as Deputy Chairperson of the Bar Council Human Rights Committee and the Bar Council Joint Committee on Environmental, Social and Governance (“ESG”). He was included as a “Rising Star in Malaysia” by Thomson Reuters Asian Legal Business. His firm was ranked a “Notable Firm” in Construction by Benchmark Litigation Asia-Pacific and a “Firm to Watch” in Projects and Energy by The Legal 500 Asia Pacific.

Ooi Wei Qian (Moderator)

Founder and Principal, The Chambers of Ooi Wei Qian

Ooi Wei Qian is the Founder and Principal of The Chambers of Ooi Wei Qian, a legal practice focusing on arbitration, construction law, and commercial dispute resolution. Prior to establishing chambers, Wei Qian served as Senior Case Counsel at AIAC, managing over 900 cases across arbitration, adjudication, mediation, and domain name dispute resolution. She was a task force member for the reform of CIPAA and served at the Secretariat to the Protem Committee for AIAC Court of Arbitration, playing a key role in its establishment. She regularly speaks at industry conferences on behalf of AIAC, mentors junior colleagues, and contributes to professional publications of AIAC.
