Vehicle Passenger Ejection Accident

Background

A claimant testified that they were sitting in the back seat of a convertible when the driver swerved hard to the left which ejected them from the vehicle.

Rimkus was requested to perform an accident reconstruction and analyze the dynamics required for the back seat passenger to be ejected from the vehicle. During the course of our investigation, we inspected, measured, and photographed the area where the accident occurred and the vehicle. We reviewed medical records including results of CT scans and depositions. We performed critical speed and airborne speed calculations and we created a three-dimensional computer model of the passenger positioning in the vehicle. Our analysis showed that the passenger would not have been ejected from the vehicle if they were sitting in the rear seat.
