Design and Construction Dispute at Specialist Flight Training Centre

Background

A dispute arose concerning the design and construction of a specialist flight training facility in Asia. The developer alleged design and installation deficiencies in the structure and cooling systems that supported high-intensity simulator equipment. The matter proceeded to arbitration, requiring independent expert input on building services engineering to assist in resolving the technical and contractual issues in dispute.

Services Provided

Rimkus was appointed as an independent technical expert to assess the adequacy of the structural and mechanical systems. From a structural perspective, the commission involved an assessment of previous structural remedial works and their effectiveness, and development of a scheme of further remedial works which would address vibration issues whilst minimising impact on the operations of the facility. From a building services perspective, the commission involved a forensic review of the design, installation, and commissioning of the cooling infrastructure, electrical distribution systems, and associated components. As part of the engagement, Rimkus also examined contractual documentation to determine the allocation of responsibilities between the developer, contractor, and consultants.

Results

Rimkus’ investigations identified a much reduced scope of structural works would resolve the alleged issues.  In relation to the building services, Rimkus identified deficiencies in the installation and commissioning of specific systems, while clarifying that other alleged shortcomings were either misattributed or of limited relevance. The analysis helped narrow the scope of viable claims and ensured technical issues were properly contextualised within contractual obligations. Rimkus’ independent cost input enabled claims to be challenged and damages to be assessed proportionately. The impartial findings provided the Tribunal with clear evidence on both technical and quantum matters, supporting a fair and efficient resolution of the dispute.
