Background

In 2024, a dispute arose concerning the design and construction of a hyperscale data centre in Europe. The developer alleged delays and design deficiencies in the MEP and architectural packages, resulting in substantial claims against the design consultant. Proceedings were brought in the United States, requiring independent expert input on building services engineering to assist in resolving technical issues.

Services Provided

Rimkus was appointed as an independent technical expert to conduct a forensic review of mechanical and electrical design issues. The scope included assessing compliance with European standards, evaluating electrical infrastructure and critical equipment, and analysing the contractual scope and responsibilities between the parties.

In addition to the technical review, Rimkus provided independent quantum advice to support the legal team in proportionately evaluating damages. Close coordination with legal counsel, delay specialists, and other expert disciplines ensured a cohesive and robust approach.

Results

Rimkus’ expert evidence helped clarify areas of agreement and narrowed the dispute to specific technical issues with minimal impact on the broader claims. The findings showed that several alleged design omissions were either misattributed or had limited relevance to the overall damages. The impartial, evidence-based analysis enabled informed decision-making and supported a fair and efficient resolution of the dispute.
