    But What Will it Cost? – Analyzing Surety Performance Bond Claims

    This course provides an overview of Cost to Complete (CTC) analysis for bonded construction projects after a termination or claim has been deemed justifiable. Participants will learn how sureties use CTC to establish loss reserves, evaluate exposure against the bond’s penal sum, and determine the most viable and cost-effective completion strategy. Completion options discussed include managing the defaulted principal, engaging a replacement contractor, reletting the completion contract, or resolving the claim through a penal sum settlement. The course also explains how CTC is calculated by comparing remaining contract balances and pending change orders against anticipated completion costs, including construction costs, unpaid earned funds, general conditions, fees, liquidated damages, and contingencies.

    Subrogation Opportunities in Environmental Claims

    Subrogation Opportunities in Environmental Claims is a one-hour course designed to educate insurance company participants concerning how to recognize or distinguish when environmental liability for an event may not, in entirety, be the responsibility of one carrier. A thorough investigation into the causation of a contamination event can shed light on other parties who may be jointly or solely responsible for the event. In many cases, other professional disciplines may be needed to accurately assess the contamination causation. A brief background will be established concerning typical environmental events and claims that arise from chemical and/or other releases causing damage. Common types of subrogation cases will be discussed, as well as situations where the damage event may be exacerbated by the remedial / abatement approach conducted by the contractor. Multiple case studies will be implemented to demonstrate keys concepts discussed, including the various professional disciplines used in these types of analyses.
