You’ve both trained others in your field and testified as an expert witness — what’s the biggest challenge in communicating complex digital forensics findings to a non-technical audience like a jury?
As an industry, the challenge comes from technical people being too technical. In other words, over-emphasizing the necessity for technical excellence while neglecting the development of their communication skills.
If you could give one piece of advice to an insurance adjuster handling a digital forensics claim for the first time, what would it be?
You may handle the claim, but you have to think about the court case. Remember spoliation. Bring experts on early in the case. Handle the evidence like it’s actually evidence (collect and protect it quickly, correctly, and completely) or risk the consequences of spoliation and negative interferences – and the accompanying complications.
