What is a common mistake that parties make early in a construction dispute matter that complicates the investigation later?
In plaintiff matters, attorneys will often file complaints prior to an objective investigation, putting the cart before the horse.
What is a case finding in your career that challenged a widely held assumption in construction dispute?
That architects are responsible for coordination of engineering and other sub-consultants’ work. The term is often misunderstood to mean verification of the competence of that work, and there is seldom any articulation of the specific tasks that an architect did not perform.
What do you wish more people understood about the work you do in construction claims and disputes?
The individual responsibilities of the various entities in the course of designing a building; without this understanding, there can be misunderstandings of expertise for forensic matters.
Background
Mr. Seth Rosenman is a registered architect with a Bachelor of Environmental Design degree and a Master of Architecture degree. He has practiced architecture for more than 40 years, is registered in 13 states, and holds a certificate from the National Council of Architectural Registration Boards (NCARB).
Mr. Rosenman has held leadership positions in several firms, including his own architectural practice. He has experience in all phases of building planning, design, and construction for public and private clients, and across many project-delivery methods. Among his project types are public buildings, offices, university buildings, museums, schools, research laboratories, and residences. As a hands-on general practitioner, Mr. Rosenman has been the project architect and lead designer on projects large and small. He has expertise in historic structures, with tenure on the Denver Landmark Preservation Commission (a mayoral appointment) and as a trustee of Historic Denver, Inc. His work has been published in the journals Architectural Record, Interiors, and Architect Colorado, among several other periodicals, and he has been the recipient of several awards for design excellence.
In the course of practice, Mr. Rosenman has accrued extensive experience in site and building design, project management, and the execution of building projects, with particular expertise in building enclosure design and evaluation. He also has experience with issues pertaining to building code analysis and compliance, encompassing life-safety and accessibility. Further, as a practitioner, he has routinely evaluated the performance of contractors and sub-consultants, and he has successfully mediated between competing interests. With service as a principal in large and small companies, he is fully versed in design, architectural practice, firm operations, and professional standards of care.
